Guidance Note on the EU (Supplementary Pensions Rights) Regulations 2019
The Pensions Authority has published a Guidance Note on the European Union (Supplementary Pension Rights) Regulations 2019. These regulations raise many practical issues for Trustees and also appear to provide a different interpretation of the benefits Outgoing Workers are entitled to than has been the case in other countries that have implemented the Directive. The Guidance note also does not deal with the tax issues that might arise with Revenue as a result of refunding employer contributions. We will be following up on these issues with the Department of Employment Affairs and Social Protection, the Pensions Authority and Revenue.
EIOPA Data Reporting
The Pensions Authority has confirmed that the “look through approach” required for schemes with assets over €1bn will not be required at 31/12/19 but at 31/12/20 for the first time. A link to the Authority’s Update is here.
